Good morning, I requested a copy of my Credit Agreement and supporting documents from the debt collection agency (Allied International) following me for payments. I used a letter template found online, included the £1 fee, and had it sent signed delivery. It was signed for on August 5th, making today (23rd August) the deadline for said documents to arrive. If all was simple, I would assume that Allied International is now in default and should be celebrating hard if all were simple.
Unfortunately the situation isn't so simple. The original loan company (Barclays Partner Finance) contacted me on the 14th August to tell me they have passed my debt on to a debt collection agency for action. I have not heard from any other debt collection agencies since then.
Allied International threatened to take me to court if I did not pay the full amount and since then there have been no communications between us, apart from my request for my credit agreement.
I would highly appreciate if somebody with some experience in these matters could help me make sense of this situation, as I really can't plan my finances until I know where I stand on this. As such my main questions are:
- Could Barclays Partner Finance have taken the loan back?
- If so, is this legal, and do they still have to provide my credit agreement from the same request?
- If Allied do still control the loan, are they now in default?
- If so, what does this mean for me and what action do I need to take?
- If Allied are now in default, but do not acknowledge it, how do I go about taking legal action?
