Default Fraudulent Loan Now Says: Claim Filed With Government

Ok, so its a huge long story.. here goes:

When I first saw my credit report in December 2009, I noticed this and right away knew it was not mine. I have never taken out a student loan for $14K... Looking at the dates of this Bank of America account, something seemed very strange to me. My mom (who has the same name) attended a vocational college the same dates that the loan was current for... once she graduated, she stopped making her monthly payments and therefore sent this loan into default (obviously I had no clue about this until I pulled my report up.) I believe my mom took out this loan against my social security number (very illegaly). I am now being punished by this, and unjustly so. I tried disputing this in December and it was not resolved. I tried again in late December, and yesterday I heard back from TransUnion and again, the item has not been removed. I typed out a big long letter explaining what happened, and made my mom write a letter explaining what she had done, and the letter was notarized.. it is going to be sent to TransUnion tomorrow. Did I do the right thing?

Furthermore, the remarks on this account are "Claim filed with government." This is what really really frustrates me at the current moment, because doesn't that mean that the government will take my tax refund this year in order to pay off this loan? And doesnt that mean that at any time the government can start garnishing my paychecks to pay off the loan? I dont know what to do... I'm stressed more than words can say and I feel incredibly powerless.

When I confronted my mom about this, she claimed the vocational school was at fault. I think i know better than to assume that the school would magically guess my social security number to pull out this loan, though. She became incredibly defensive and tried making me feel guilty for blaming her for this.. that's besides the piont though.. the bottom line is that in no way shape or form is this loan mine. I know that my mom is responsible, now I have to prove it... I'm especially concerned with the tax refund and wage garnishment issue. Thanks so much for your time.

Hello TFICH11.
I hate to have to say/write this but the only way you will be able to resolve this is by reporting it to the police as it sounds like fraud, your mother new your social security numbers and used them to benefit from the loan, she even made some payments so check her bank details with the filled out direct debit mandate that the loan company would have on file if its her account details that will help you prove your mother is a fraudster, you sound as if you are from the USA, so the law might be a little different here in the UK, if you don’t do something quick about it your life will be hell, because if you have a messed up credit rating you will not be able to move on, so your mother has really dropped you in it from a grate height, sorry to say, if the you don’t settle this and it is a government department they could in the end say you new all about it and you never know have you sent to prison, “Thanks Mom”

I buy Barry's view. You need to deal with this issue fast enough before you become to implicated in it. Who will believe you didn't know? But considering it is your mom, talk things first with her and make her know your decision before taking actions
